Well his legal guilt or legal innocence will be determined by the interpretation of the law in that Province. I don't know if a screw-up by the Court can make a guilty person Innocent but it can certainly make an innocent person "guilty" as Canadians know so well after enduring the shame of seeing so many convicted murderers being later exonerated on DNA evidence--and the justice system--from crooked cops on up--going Scott free.
