The claims arise from the fraudulent scheme perpetrated by Defendants through Genworth's marketing, solicitation, sale and management of the Portfolio.

The complaint alleges that the scheme was facilitated by Defendants, who knowingly, recklessly and/or with intent to deceive disseminated to prospective and current investors materially misleading representations regarding the Portfolio and its "exclusive" management agreement with Robert "Bob" Brinker.


Do you think Genworth would have had any funds managed under "its "exclusive" management agreement with Robert "Bob" Brinker" if Brinker was not feeding them clients via his newsletter and web site?

BTW, note from the screen shot that Brinker himself claimed he is a partner in this scheme.

Go back and look at issues of Marketimer from before this lawsuit was announced and you will see Brinker would sometimes advertise such as this money management advertisement from mid 2009, just over a year ago.

BTW, do you think someone who advertises himself as a "partner" in a money management scheme has a moral obligation, if not a fiduciary responsibility, to make sure the money is invested as advertised?
