Of course. It's why so many assumed that Bush KNEW that there were WMD in Iraq - because he was privy to intelligence the rest were not - including the legislature.

But, a president CAN do pretty much what he wants, subject to reversal, impeachment, electoral losses, no re-election and assassination.
