As James Hutton pointed out, BP has grabbed them by the sac.
Take our dirty money or screw up your claim by not mitigating losses when able. Then after taking the money laboring to clean up their mess, you can fight them again trying to get worker's comp.

I guess with enough evidence, you could argue you weren't about to risk your health being exposed.
