BP has already agreed to pay, and has already put aside (even already paid) much more than the cap amount.

Also if they had not done so, and the government had found BP in violation of safety regs the cap would be inoperative. I suppose the oil companies lawyers could argue that their liability should be limited because of it, but it would be similar to trying to use the Chewbacca defense.
