An argument could be made that the tort system is out of control, and that the realistic possibility of a crazy high award or collection of awards suppresses investment too much.

But if your responding to that as a real need, then it should be addressed as a real need. A super leaky cap that usually won't apply anyway, doesn't plausibly solve the potential problem. At the same time, in this context (unlike in many other potential tort situations), a total of $75mil (for non cleanup costs), isn't "crazy high", but is instead very low.

It seems to me to just be a stupid law from any reasonable perspective that I can come up with.
