If you wait for the lawsuit to be settled your looking at at 12-24 months, by that time S3 will not be at $6 or $7 or $8.

May I assumed that if your listening to your broker, then he must be the one you got you into this thing,(at the very least he didn't keep you out of it) then advises you to sell at a loss, then suggests to re enter at $6???? And you say thank god for my broker??? They have a name for that kind of advice, its called churning. As an x-broker I'm not a big fan of that profession.
