There is no limit on the amount of tax companies (except it would be silly to have one without a taxi) there is a limit on the number of taxis. There is a deliberately created under-supply of taxis. You could decrease the number of companies (if that was a real problem) while still increasing the number of taxis).

As for unlicensed drivers that is what you get because of the restrictions. Since you don't have enough legal cabs allowed you get a black market, with "gypsy cabs" and other services, no inspections (except maybe the normal car inspections), etc.
