The whole thing sounds very strange to me. If MIS AG were being sued for Patent infringement by Applix, there would be a legal contest. However, Applix is only *threatening* such action. It isn't even clear whether these "threatening" statements by Applix are written or verbal.

The second point, the "request for declaratory judgment that the two patents, directed to Applix's multidimensional array spreadsheets, are invalid, unenforceable and not infringed by MIS AG" is ludicrous, imo. A declaratory judgement is synonymous with "getting the judge to agree with you". This is not the way patents are opposed. If I were the judge I would dismiss the case. (Disclaimer: all I know about the case is the refereced artcile.)
