You are probably right, but I do distrust Snopes because they are so left-biased.

I don't rely on Snopes and when I read their entries, I do so knowing they have a liberal bias. That said, Elena Kagan was the Solicitor General and she appears as counsel of record in any Supreme Court cases in which the government is involved, whether it be representing the United States itself or any of its officers. She would undoubtedly have to recuse herself from sitting on any case that makes it to the Supreme Court that she had had involvement with in her tenure as SG.
