Yes and No. (No in this case and I think in general practice, yes in theory.)

No in that what I'm saying that the story was reported as happening that way, but it turns out the actual accusation and initial charge was of forcible rape.

But yes in theory, because if the alleged perp plee bargained to such a charge, such a charge actually has to exist on the books, even if its never enforced.

A similar law (covering "rape by fraud") was in front of the legislature of a US state, but I don't know if it passed.
