This is very unlikely since it would be easy to prove tax fraud for the Chinese government officials. If it is the other way and they defraud US investors nothing will happen to them (unless they are stupid enough trying to enter US territory). The US shell company will be close down by the SEC, the Chinese fraudsters will keep their loot (no extradition agreement with the US) and US investors are out their money.
