Your analysis is weak. I disagree with all of it.

As far as the legality of past wars goes, the War Powers Act provides congress the power to wage and manage wars. It has never been successfully challenged as unconstitutional. So, like many things (abortion, pornography, campaign finance, gun ownership, certain taxes, etc.), people may disagree with it, but it's legal and constitutional.
