Folks that haven't reached 59 1/2 can withdraw funds from an IRA penalty-free...

At last count there are 7 exceptions to paying the 10% early withdrawal penalty. See: retireplan.about.com

Also, an individual retirement account is not jointly owned as previously posted. However I believe there are survivorship guidelines/rules based on the state you live in.
