Wrong. I clearly answered your question ('no I don't think that SHOULD BE legal...') and I went on to explain the CONSTITUTIONAL RULINGS by the Supreme Court (expanding the 'commerce clause' to cover most EVERYTHING) that *underlies the expansion of federal authority into both* areas** and, unfortunately, makes both federal expansions legal today. Those rulings make both legal and, (if the expansions of the commerce clause are trimmed back AS THEY SHOULD BE!), then BOTH areas of federal control must fall by the wayside.
