I clearly answered your question ('no I don't think that SHOULD BE legal...') and I went on to explain the CONSTITUTIONAL RULINGS by the Supreme Court (expanding the 'commerce clause' to cover most EVERYTHING) that underlies the expansion of federal authority into *both* areas and, unfortunately, makes both federal expansions legal today.

Those rulings make *both* legal and, (if the expansions of the commerce clause are trimmed back AS THEY SHOULD BE!), then BOTH areas of federal control must fall by the wayside.
