Yea but all legislation passed by Congress generally cites it's Constitutional authority. Almost everything Congress passes these days they use the Commerce Clause allowing them to write laws on anything, including regulating sex in marriage if they want to because of the commercial influence on prostitution. I will have to look it up for Social Security to see what Constitutional authority they cited in the original act if any.
