That's one of many reasons why Obamacare is such bad legislation. The legislation actually sets up this waiver system as a part of the process, but it doesn't specify what criteria is used. The Secretary can just make it up, any way he or she sees fit.

The legality of all this seems weird. Congress passes a law and then the executive branch grants waivers to certain groups?

The Gov PLANS IT this way. Pass a law, then make you line up and beg to be let out of following it.
