It is a very interesting situation. Personally, I have yet to see a case where the company foreclosing does not have the right to foreclose, but here in Virginia, the lender does not have the burden of proof, and we don't need judges to approve foreclosure.

We have discussed this in-house. If a meritorious case presented itself we would defend but this hasn't been an issue for us yet.
