Fined yes, physically shut down I doubt. They'd have to go to court and it would take forever. The hefty daily fines don't kick in for a few months after Mar 1. I don't think any of us expect this charade to still be going on by next summer.

IMO they'll just move it to Canada and start over with the permitting process. The only reason it's in NY to begin with was to hype US franchises (all the other pieces are now in CA). That angle will be going away shortly (JV's now need their own recycling centers and blending facilities apparently). JB will then operate his P2O machine unprofitably until the money dries up - maybe loans from the same people behind the various acquisitions (from the proceeds of their stock sales and using the original assets as collateral). Then comes bankruptcy for JBII, the creditors take their original (now improved) properties back and everyone walks away with what they started with plus the remaining proceeds from their stock sales.

That's how I imagine it anyway.
