FWIW - I have been working on this issue. If this rule were permanent it would change everything. FWIW again - the other purpose of a Trust is to avoid probate.

I spent the morning with my tax guy strategizing the end of the year. To me it is clear that the system is corrupt in that it can be beaten by means of legal tax avoidance. It makes me believe a National Sales Tax is more fair than the current income tax.
