There's a big difference. And Clarence Thomas's dissent does not address it directly. He said: “Respondent's local cultivation and consumption of marijuana is not "Commerce". He didn't say: “Respondent's non local cultivation and non consumption of marijuana is not "Commerce". The mere existence of being is what is being argued in the courts for the first time on Obamacare. Does the commerce clause cover people not engaged in any activity? If it does, we are not a free people.
