Here's the first call to trash the 1st amendment over this - democrat of course:

According to The Hill, the Democratic lawmaker “plans to introduce legislation that would make it a federal crime to use language or symbols that could be perceived as threatening or inciting violence against a federal official or member of Congress.”

...i have also read that loughner may have a relative that works for the county, so who knows, was there any undue influence there as well (not to prosecute)

without a charge and prosecution, i'm not sure there would have been any legal way to restrict his purchasing a handgun without at least some sort of legal action pending
