The first point is that if the death penalty is imposed, there will be greater public confidence in the verdict if Loughner is represented by the strongest possible lawyer. IMO, the die has already been cast. Loughner will go to some AZ funny farm. His high school and college friends, his computer chat friends, his family, and the MSM have already set the table on his clarity of thought. Even the fool sheriff helped with his decision making on Loughner. I think the only possibility of him spending time on death row is if the Congresswoman doesn't make it. One prosecution argument will likely be premeditation versus the defense position of insanity since he had prior contact with Gifford in '07. Another quickly and poorly written book and script for the film world with a negative slant toward anyone and anything politically conservative.
