Such "logic" can be used to argue for any and every government mandate.

Don't like the TSA groping your private parts? Tough, it's there for "equal protection" (i.e. you get treated the same as a possible terrorist) and the safeguarding of your "Pursuit of Happiness."

Wealthy landowner using eminent domain to take your property and build his own rich man's playground? I'm sure you can justify it in a similar fashion.
