Earnings to be released shortly. I'm long on a small EK position, and have a big percentage loss in it. IMO- Kodak's biggest problem is it's underfunded pension liability. Kodak Plunges 14% On Initial ITC Rejection of Apple, RIM Suit By Tiernan Ray Shares of Eastman Kodak (EK) are down 71 cents, or 14%, at $4.51 after the company late yesterday said it received an initial determination in its suit with the International Trade Commission that its claim of patent infringement by Apple (AAPL) and Research in Motion (RIMM) is not valid. Kodak said it was confident that in the final measure it will prevail in its claim the two companies infringed Kodak’s patent for previewing images “in a digital camera-enabled device,” which it said affects RIM’s BlackBerry Devices and Apple’s iPhone. Kodak brought the claim a year ago. Yesterday’s determination was handed down by the Administrative Law Judge at the ITC, but a final decision awaits a meeting of the full International Trade Commission and is not expected until May 23rd. Kodak noted that it had previously had the same patents upheld in claims against LG Electronics (LGERF) and Samsung (SSNLF), Attorneys at the ITC’s Office of Unfair Import Investigations agreed with Kodak’s interpretation, it said. “We fully expect the ITC Commission will ultimately rule that the patent claim at issue is valid and infringed by Apple and RIM,” the company said.
