Yes, I recall that and many things. I also recall reading some interesting thoughts from Ginsberg on the incorrect use of the commerce clause. I also have to note that judges appointed by conservative presidents have always acted as conservative justices. A certain freedom comes from having reached and passed the final stage of appointments in your career. They have only their own minds to satisfy. A sound mind will seek to interpret the constitution faithfully.

I reserve judgement on their decision. I believe in good surprises. We have had too much of the other.

If the people see that the constitution is no longer respected to a serious degree, it causes a serious affect on balance. The Supreme Court is like the inner ear. If it goes, we all fall down. I don't want to think of what could or would happen, but there is writing is on the wall.
