The courts.

Assume 2/3 Congress signs, 38 states sign, President does not veto

The President doesn't get a veto on amendments. If an amendment is passed, it becomes the constitution. There is no such thing as an "unconstitutional constitutional amendment" unless the process was not observed as spelled out in the constitution for amendments.
