Congress didn't sever the provision, it amended the law. If legislation does not have a severability clause the courts have two options: strike down the whole thing, or don't strike it down at all.

so they amended an unconstitutional law as decided in federal court....

i agree with you, i think this creates a precedent (if allowed to stand) to make piecemeal amendments to it...
