From Vinson's decision, page 67...

the absence of such a clause [severability], in and of itself, “does not raise a presumption against severability." [New York, supra, 505 U.S. at 186]

The USSC could, in fact, overturn Vinson's severability analysis while affirming his decision on the mandate.
