I didn't take a position on fault; just clarifying a general matter of contract law.

If you want my opinion, it was the banks' fault, and the mortgagees' fault, and everyone else who was trying to get something for little or nothing of substance out of the whole process.

Who in their right minds would lend that much money to people who could not pay it back?

Do you understand due diligence a bank is supposed to do before approving loans?

It is obvious you do not understand how banking worked for centuries.
This has always been step one: Will the borrower be able to pay us back?

The banks use to want their f`ing money back!
