Not so Kenneth! The bill is not presumed constitutional in any challenge. The bill was declared unconstitutional by a federal court and in any appeal both parties or all interested parties have to submit briefs stating the reasoning and constitutional support for the bill.

It would be hilarious if the Obama Protectors did not submit a brief and just stated the bill is presumed constitutional!!

You do know of course that the bill is unconstitutional. And it will stay that way until a successful appeal is argued.
