The argument is regarding your "presumption of constitutionality" and in the case of the florida District ruling there is no such presumption on appeal.

That was the Virginia decision.

The Florida decision, where Judge Vinson ordered the entire law null and void, has not been appealed. As of right now, Obamacare is unconstitutional.
