As previous Commerce Clause cases have all involved physical activity, as opposed to mental activity, i.e. decision-making, there is little judicial guidance on whether the latter falls within Congress's power...

So this judge now sets a precedent for mental activity becoming a regulatable activity. Who cannot imagine whacko libs applying this precedent to criminal law where thinking bad things of someone qualifies as criminal activity? There are plenty of shrinks who could coax such admissions from subjects. Why I could be incarcerated for what I'm now thinking about this judge. Come and get me, all you lab coats and robes!
