JUDGE KESSLER’S MENTAL OBAMACARE RULING WAS INEVITABLE

Judge Gladys Kessler has become something of a laughingstock among legal scholars because of her claim, in her recent ruling upholding ObamaCare, that the Constitution’s commerce clause allows Congress regulate mental as well as physical transactions:

You really don’t have to be a graduate of Harvard Law School to see that Kessler is WAY off the reservation (ahem) on this one. But my bet is that this isn’t that last we’ll hear of this surreal argument.

In a way, ObamaCare advocates MUST make this wacky argument. Their tax claim has been shot down by 6 judges (including Kessler), so they have to find some way to make their commerce clause position stick.

And, because the success of the DOJ’s commerce clause position lies in their ability to convince the court that not buying insurance is an “activity,” the mental activity route is about they have left.
