Any lawyers care to comment? Can Vinson rule that the administration has waived its right to appeal?

If they don't file in the time prescribed for appealing a final order, they've waived appeal and it's done and sealed. Vinson's order would be final and unassailable until the Court of Appeals, or the US Supreme Court, takes up the issue from another case and makes a contrary holding.
