Actually considering the vast mobile patents that Motorola has, it could easily be the other way where Microsoft would have to pay Motorola (Motorola and Microsoft have already sued each other)... but most likely they will end up reaching a cross licence arrangement me thinks.

Remains to be seen but Motorola is not suing Microsoft based on their mobile patents rather based on claims they hold patents that Microsoft's operating system infringes. Hard to believe but lawyers will hash it out. Whatever Android OEMs' thin margins aren't helped by paying licensing fees for the "free" Android operating system. And we haven't even mentioned the elephant that may be in the room, Oracle.
