i'm not clear on what you mean by your question. i'm also not clear on what the money from the bonds will be used for.

based on my sometimes failing memory, i believe the shares issued to Phoenix were collateral for the land and if no money was forthcoming would be kept by Phoenix as payment. need to reread the press releases to be sure.

This is from the release:

<<The company and Omega Investment are negotiating an extension of time on the purchase agreement with respect to the acquisition of the additional 20% interest in the Black Rock property. IPM is also negotiating the additional financing to conclude the purchase.>>

I know of a fund manager posting on the Crystallex thread last week (re: his reluctance to take a position in IPM) that was concerned about the lack of news on this property deal with Phoenix, the deadline of which was October 15.
Not a done deal yet, but evidently Omega feels it is worth persuing.
