Once again, though, there's no evidence Apple is actually using the information in any way, or even that they upload it.

And your post badly mischaracterizes my opinion on the matter, to the point of being libelous. I said nothing like that. In fact, if there is anything illegal about anything Apple is doing, I am not in favor of it.

I'm not qualified to say one way or another whether that law applies to what Apple or Google is doing, but if it should turn out to be illegal as a matter of fact, I don't see why it should be. Google Maps benefits from being able to display real time traffic data. We don't have that functionality without the army of GPS-enabled handsets out there transmitting real time location to Google. I'm willing to be part of the crowdsourcing of traffic data as long as google promises to track me anonymously.
