Federal agents search, seize products at offices, home of nutritional product maker

Hood River Police Chief Bruce Ludwig confirmed today (April 20) that his agency last week assisted 46 federal agents in serving a search warrant at two business locations and the personal residence of Hood River businessman James G. Cole.

“We assisted the Internal Revenue Service Criminal Investigation Division and the U.S. District Attorney and were present when they served the search warrant,” Ludwig said. “They seized product from the shelves and some machines that are supposed to help you lose weight.”

Cole, according to his Facebook page, owns Maxam Nutraceutics, TurboSonic USA, Advanced Sports Nutrition and the fitness center, The Big Gym.

The company, with offices at 1020-D Wasco St., produces and markets nutritional supplements online and through the Big Gym. Visitors to the Maxam Nutraceutics web site on April 20 were greeted with the message “Our website is currently under maintenance. If you need assistance please call 1-800-800-9119.”

The Food and Drug Administration on Oct. 12, 2010, issued a warning letter to Cole and Maxam. Before getting into itemized detail, the letter said:

“This letter concerns your firm’s marketing of your products: PCA-Rx, PC3x, AFX, AD-Rx, AN-Rx, Anavone, AV-Rx, BioGuard, BSAID, CF-Rx, CreOcell, Dermatotropin, Endotropin, GTF-Rx, IM-Rx, Keto-Plex, Natural Passion, NG-Rx, NX-Rx, OR-Rx, Oxy-Charge, PN-Rx, Ultra-AV, Ultra Pure Yohimbe, and the Heavy Metal Screening Test on your website, www.maxamlabs.com1. These products are marketed in violation of provisions of the Federal Food, Drug, and Cosmetic Act (the Act) as described below.”

When asked if the recent search and seizure had anything to do with that warning letter, Charles Breen, Seattle District director of the FDA, would say only that “I know of what you’re saying.”

He referred us to Alan Bennett, the district’s public affairs specialist, who said he had no knowledge of the matter, but would check into it.

A subsequent call to the U.S. Attorney’s office in Portland led to no additional information.

A search of the U.S. Court system’s online database showed no current court activity involving Cole or Maxam.

Cole was traveling and unavailable to comment when the Biz Buzz tried to reach him Wednesday (4/20/11) afternoon.

She is amazing and must be backed by somebody wealthy, as filing lawsuits and being fined is not free. I always thought there was some way to stop obvious nuisance lawsuits, but, I can see where that might be unconstitutional. No wonder the courts are backed up with her around.

The worst insult of all: Whenever Rush Limbaugh said something extraordinarily ridiculous, Keith Olberman would call him Orly Taitz Limbaugh. I don't think even Rush would want to be compared to her. <G>

Obama may or may not win reelection, and I have mixed feelings about him right now, but the Gas and Oil Party (GOP) is certainly handing the Democrats Congress on a silver platter. First, Ryan laid out in black and white that the GOP wants to kill Medicare. And, Boener foolishly forced every Republican in the House to vote for it. Now, at town meetings, seniors are up in arms. I don't think they really understood how popular Medicare is with seniors and with those who hope to be seniors some day.

It is fun to hear the GOP reps back pedal My favorite is the guy who said he didn't vote to kill Medicare. He voted for a budget blueprint. And a senior says, "a blueprint that will kill Medicare."

Unlike Medicaid, Medicare is an isurance program we've all paid for. Killing it is stealing our money. Which they do all the time, but they rarely tell us about it. The voucher program is beyond idiocy. An $8000 voucher may sound nice, but many, many seniors can't get insurance at any price and most cannot get it for $8000. The older you get, the less the voucher helps.

To put it into perspective, my Mother is 82 years old. She receives Medicare and has purchased a "no frills" supplement plan from by far the cheapest provider. The supplement costs her over $5000 a year and pays 30% of Medicare approved charges. This is a two part problem. First, a policy from the same co. that pays the entire amount would cost her over $16,000, assuming she could get it, which I doubt. Secondly, it would probably cost much more than that high number as Medicare would not be setting prices for services and no one insurance co. can get anywhere near Medicare's low prices.

Does Medicare have to be reformed? Maybe, if we don't deep six the private insurance system that is medical insanity. But to kill is to set up a fiscal death panel. The huge problems with private insurance cos. was the reason Medicare was passed in the first place.

2. Many, many GOP reps made total fools of themselves over the birther thing. In places like Arizona and Alaska, it doesn't matter. But, it does in swing states. Nobody likes to think they have an all day sucker representing them. True, they may go for another Republican who isn't quite so stupid, but even that would be an improvement.
