Oil Pollution Act makes the 'responsible party' - BP - liable without the need to show fault. Although there are liability limits, I recall that BP waived them.

This does not mean that BP cannot sue another entity to recover in the event its fault caused it to pay.

From what I can tell, there are a number of parties who are likely to be found at fault.
