THE COURT: Specifically, in the Memorandum of Plea Agreement it says on the front page that the maximum penalty for each of Counts I and V, includes 5 years imprisonment, 3 years of supervised release following any term of imprisonment, a $250,000 fine and a $100 special assessment.
Do you understand those are the maximum penalties for those counts?

THE DEFENDANT: Yes, your Honor.

THE COURT: Do you see paragraph C, Counts IV and VIII charge you with Conspiracy to Commit Money Laundering, that the maximum penalties on the next page at the top for each of Counts IV and VIII include each of the following: 20 years imprisonment, 3 years of supervised release following any term of imprisonment, a fine of $500,000 or twice the value of the property involved in the offense whichever is greater and a $100 special assessment. Do you understand those are the maximum penalties for
Counts IV and VIII?

THE DEFENDANT: Yes, your Honor.

THE COURT: Do you understand that in Federal Court we have sentencing guidelines and there will be a calculation of what the guidelines tell us about sentencing of other individuals similarly situated to you? Those guidelines are advisory to the sentencing judge, but they have to be consulted along with the consideration of some other statutory factors. Do you understand that?

THE DEFENDANT: Yes, your Honor.

THE COURT: And you understand until all that's done -- once all that's done, there will be a sentence fashioned for you and imposed by the judge?

THE DEFENDANT: Yes, your Honor.

THE COURT: Has anybody promised you what the sentence is going to be?

THE DEFENDANT: No, sir.

THE COURT: You can be advised what the guideline range might be, but no one can tell you what the actual sentence might be. Do you understand that?

THE DEFENDANT: Yes.
