05/24/2011 192 Minute Entry for proceedings held before Judge Timothy C. Batten, Sr. as to Rufus Paul Harris, Benjamin Stanley, Darryl Horton: Jury Trial continued on 5/24/2011. The Court was informed that Mr. Harris had not appeared for court and it was discovered that Mr. Harris had fled. Counsel were asked to research the law and a telephone conference will be held at 4:00 pm today to discuss whether the trial can proceed. Counsel are to provide a proposed draft charge to the jurors regarding any inferences jurors can or cannot make regarding Mr. Harris's absence. The two witnesses that failed to appear yesterday have now appeared and are required to stay through tomorrow. Upon motion of the Government, the Court orally stays execution of the warrants until after the witnesses testify. Counsel are to email case law to the Court by 3:00 p.m. regarding continuing the trial without Mr. Harris and then call chambers at 4:00 p.m. for a telephone conference.
