I just spent the last thirty minutes investigating Amerindo's web site,
which seems to have to some degree evaporated, making one wonder about
the current status of the fund. If you attempt to go to their website
directly (amerindo.com) the result will be "Document contains no data".
If on the other hand you use the Net Search function and enter
"Amerindo" you will be able to access some--but not all--of the web
search result listings. Additionally, some search engines are more
complete than others--I tried four. When you finally get in, everything
seems to come to a screeching halt with the Q2 report dated June 31,
1997. There is nothing available or even listed after that date. I then
tried calling the New York office, and when I followed the voice mail
prompts in an attempt to reach Vilar's office, the message that resulted
was "Invalid ID". Has he left the firm? Performance for '96 was a measly
8+% after the 80+% gains of the year before, and this year things have
continued to slide even more. The Amerindo funds had 2-3 billion under
management, and with their largest position having been in ASND (as
previously stated, 5.2 million shares following the ASND/CSCC merger) it
is possible that heavy redemptions may have forced Vilar and Co. to
start unwinding their positions. If this in fact happened, it may
explain the rather oversold situation we are currently witnessing. By
the way, in answer to your question, the symbol for the Amerindo
Technology Fund is ATCHX, but that fund represents/represented only a
small fraction of the Amerindo Funds overall. I am still looking into
Pilgrim Baxter...

......After suit was filed, Avant! undertook a "clean room " process, attempting to remove the allegedly infringing portions of code, then hired an independent consultant to examine the infringing code, then created specifications based on the Cadence code from which Avant! could write original code as a substitution. Avant!' s engineers then created new code to replace the copied code, calling the modified software Aquarius......... "In this circuit, as well as in other circuits, " the court said, "a defendant who knowingly infringes another's copyright 'cannot complain of the harm that will befall it when properly forced to desist from its infringing activities. . . .' The balance of hardships issue cannot be accorded significant if any weight in determining whether a court should enter a preliminary injunction to prevent the use of infringing material in cases where, as here, the plaintiff has made a strong showing of likely success on the merits. " ......... "If the Aquarius software infringes Cadence's copyright, the district court should have entered an order preliminarily enjoining Avant! from selling the software. "

ÿOn the first day of the DAC, Avanti Corporation filed a motion in the Santa Clara Municipal Court asking that the Santa Clara County District Attorney be disqualified from prosecuting criminal charges against officers of Avanti for theft of software from Cadence Design Systems...... Avanti's lawyers also alleged that Cadence CEO Joe Costello, former Cadence employee Eric Nequist, and former vice president Michelle Perotta, whom the motions characterized as Costello's "girlfriend, " had shorted Avanti's stock prior to a December 5, 1995 search of Avanti's offices by criminal investigators..... On the matter of insider trading, the spokesman said, "There is not, nor has there ever been, an SEC investigation of Cadence or its employees about this matter. " Sounds like material for a daytime soap opera.
