I guess it now comes down to whether the FCC can set requirements for GPS receivers. Normally the FCC only sets transmitter requirements.

Some hints of the types of arguments the "yes they can" and "no they can't" sides of the argument will make can be found in this case from 2005:

Is it just me, or are both sides acting in a way that eliminates credibility for either side?
