I think Dennis G. (I think it was him) was right in his earlier post----
Aztech is hurting, and they get two birds with one stone--they rain on the industry leaders big parade,
and they try to use this complaint and the effect it has on CREAF stock to force a more favorable settlement of the suit
Creative has recently won against it. And some revenge to boot.
That makes sense--although I am relying on the info from this board about the earlier suit, I knew nothing about it until these posts.
But if Aztech did violate Creative's patents, what are the odds Aztech can prove Creative did the same? That likely would have been a defense (or counterclaim) of Aztech against Creative's suit--which Aztech apparently lost.
Which might mean (IMHO) that this new suit is frivolous---and that brings us to another point raised by Dennis G. (or Kiri)
---there are sanctions, in the form of injunctions, monetary fines, contempt proceedings, reimbursement of attorney's fees, and of course dismisssal,
that Creative can seek for a frivolous suit. But if Aztech is desperate, or angry, they decided to roll the dice.

Lets wait and see---I think the other news from COMDEX will be what matters in a few weeks.
