When 60 votes are needed and the bill can't go forward, that is a filibuster. On a straight up or down vote, the Reid bill would pass.

TideGlider, are there any other Senator who were not present on the Senate floor who could have voted due to illness or injury to break the filibuster or get the 60 votes?
