Company’s Ecuadorian legal counsel has advised that the order is contrary to judicial protocol and outside the court’s

jurisdiction. Furthermore, a specialized investigation team for environmental matters from the Head Office of the National

Prosecutor of Ecuador investigated the allegations and prepared a report which concluded that that there was no evidence to

support the allegations. The Company is taking all available measures to have the order reversed, which the Company

expects will be concluded shortly. The Company has voluntarily temporarily suspended operating its processing plant until

the matter is further clarified or resolved. In accordance with applicable law in Ecuador, the remaining allegations of

environmental non-compliance are required to be separately concluded.

The temporary suspension of plant operations has not materially affected the Company’s overall operations to-date. Mining

operations are continuing uninterrupted and the Company has used the downtime to stockpile resource grade material for

expedited processing once plant operations are recommenced. Any extended cessation of processing plant operations may,

however, have a material adverse impact upon cash flow generated to sustain the Company’s current activities. See “Risk
