Thanks Jon. Must be a history of such cases then. Hopefully Creative will have the patent contested and disallowed. Maybe they be able to enlist Microsoft and other companies in this effort, since they would also be effected by this patent.

Jon,

Also from a legal perspective, Aztec's announcement was incidentally meant to garner maximum attention be being filed on the day Comdex opened. But I believe the primary reason behind the filing of the patent infringement claim is tactical-i.e., the presence of this patent infringment claim can potentially be used as a bargaining chit in the damages phase of the other Aztec/CREAF proceeding. This is a not uncommon tactic/technique by trial attorneys (best defense is a good offense), and the threat of another lengthy proceeding is hoped by Aztec to be helpful in warding off any big damage settlements......

Sincerely,

Doug F.
