Okay, so anyone with over a billion in net assets (lord only knows how you intend to determine that; sounds like another inch of paper added to the tax return) is denied LTCG treatment. Would you treat that income as ordinary income or what?

Capital gains rates are not a loophole. They apply broadly. If only billionaires got to pay those lower rates then it would be a loophole, but the rate is the general rate for all capital gains.
