California Court to Teacher: Take down in 'God We Trust Banner' .. Pay Fine.

The 9th U.S. Circuit Court of Appeals has ordered a San Diego Teacher to take down a banner that says ' In God We Trust.' The teacher who has had the banners up in his classroom for two decades says the banner was free speech.

Bradley Johnson is a math teacher in the Poway Unified School District. He says the banner celebrates the religious heritage of America.

He says the banners were 'no more an assertion of a religious point of view than the Tibetan prayer flag, Dalai Lama poster and Malcolm X poster that other teachers had in their classrooms.'

His banner says "In God We Trust," "God Bless America," and "God Shed His Grace on Thee."

An earlier court ruling side dwith Johnson. But the school district appealed to the 9th circuit Court of Appeals. The Appeals Court sided with the school district.. saying in effect that a government agency (a school) can set rules for workplace speech.

The appeals court also ordered Johnson to pay the school district’s legal bill.
